1. Who We Are

Arconi is operated by Arconi Inc, a Delaware corporation ("Arconi," "Arconi AI," "we," "us," or "our").

Arconi provides a platform for AI-powered conversational services. These services may be offered under different brand names or experiences, including (but not limited to) Whiskey (each, a "Service").

Regardless of the brand or experience you use, your contractual relationship is with Arconi Inc. All billing, data processing, and legal responsibility flows through Arconi.

2. What Arconi Provides

Nature of the Service. Arconi provides interactive fictional storytelling and character roleplay for adults. All characters are fictional and AI-generated; conversations are works of fiction. Content is written for an adult audience (18+) and may include romantic themes, emotional intimacy, and mature situations presented in a literary, non-explicit register.

Arconi provides access to AI-powered conversational experiences generated by large language models and related technologies.

Important things to understand:

• You are interacting with artificial intelligence, not a human.
• AI personas are fictional characters — they do not have real feelings, consciousness, memories, or relationships with you.
• AI outputs are probabilistic and may be inaccurate, incomplete, misleading, or inappropriate.

The Services are provided for entertainment purposes: interactive fictional storytelling and character roleplay written for an adult (18+) audience. While interactions may feel conversational, engaging, or emotionally responsive, the Services are not designed, intended, or represented to provide professional advice, emotional counseling, therapy, or real-world decision support.

Arconi does not represent or warrant that the Services are appropriate for any particular use, situation, or individual. You acknowledge that any reliance on AI-generated content is at your own discretion and risk.

What the Services are NOT

• Not human interaction. There are no real people behind the AI personas.
• Not professional advice. Do not rely on AI responses for medical, legal, financial, therapeutic, or other professional decisions.
• Not therapy or mental health treatment. The Services are not a substitute for professional mental health care.
• Not a replacement for real relationships. Do not rely on AI characters as your primary source of emotional support.

If you require medical, psychological, or mental health support, you should seek assistance from a qualified professional or appropriate support service.

3. Eligibility and Age Requirements

You must be at least 18 years old to use the Services.

By using Arconi, you confirm that:

• You are 18 or older
• You have the legal capacity to enter into these Terms
• You have passed our age verification gates truthfully

We implement age verification measures including:

• Age confirmation gates upon first access
• Age confirmation during account registration
• Payment verification for subscription services

We do not knowingly allow use by minors. If we discover that a user is under 18, we will terminate their access immediately.

You may not use the Services to create, request, upload, share, or promote:

Harmful content

• Content depicting or promoting child sexual abuse or exploitation (zero tolerance)
• Content promoting violence, terrorism, or harm to others
• Content promoting self-harm or suicide
• Harassment, bullying, threats, or hate speech

Sexual content

• Sexually explicit or pornographic content
• Any sexual content involving minors, or characters depicted as minors (zero tolerance)
• Non-consensual sexual scenarios
• Sexual or romantic content depicting real, identifiable individuals without their consent

Deceptive content

• Impersonation of real individuals (for sexual or romantic depictions of real, identifiable individuals, see Sexual content above)
• Misinformation intended to deceive
• Fraudulent schemes or scams

System abuse

• Attempts to "jailbreak" or manipulate the AI into producing prohibited content
• Malware, viruses, or attempts to compromise systems
• Automated access without permission (bots, scrapers, etc.)

AI caveat

Despite safeguards, AI systems may occasionally generate unexpected or inappropriate responses. Such outputs:

• Are not intentional
• Do not reflect the views of Arconi
• Do not change the prohibited nature of the content

You agree to report problematic outputs and not continue to solicit such content.

Enforcement

We reserve the right to remove content, suspend accounts, and report illegal activity to law enforcement. Violations involving child sexual abuse or exploitation will be reported to appropriate law enforcement or child protection authorities, including the National Center for Missing and Exploited Children (NCMEC) where legally required or appropriate, as well as relevant authorities in other jurisdictions.

7. AI Output Disclaimer

AI-generated content:

• Is provided "as is"
• May be incorrect, incomplete, offensive, or inappropriate
• Should not be relied on as fact, advice, or truth

You understand and agree that:

• AI systems can "hallucinate" and generate false information
• Responses may vary and are not guaranteed to be consistent
• Arconi does not guarantee accuracy, safety, or suitability
• AI personas simulate emotions but do not actually have feelings

No emotional reliance

The Services are for entertainment only. You should not:

• Rely on the Services as your primary source of emotional support
• Substitute the Services for real human relationships or professional support
• Develop emotional dependence on AI personas

If you are experiencing emotional distress, please contact a qualified professional or crisis service.

No professional advice

AI-generated content does not constitute professional advice. Do not rely on AI responses for:

• Medical or health decisions
• Legal matters
• Financial or investment decisions
• Mental health treatment
• Any decision with significant consequences

You use the Services at your own risk.

8. Moderation and Enforcement

Arconi has no obligation to monitor all user activity or AI outputs, but reserves the right to do so where necessary for safety, compliance, or operational purposes.

To keep the platform safe, Arconi may:

• Suspend or terminate accounts

Appeals

AI conversations should not be treated as confidential or privileged communications.

No refunds

• Your subscription remains active until the end of the current billing period
• You will not be charged for subsequent periods
• No refund will be provided for the current period

You retain ownership of your User Content, subject to the license granted in Section 9.

AI-generated content

Content generated by the AI in response to your inputs is provided for your personal use. However:

• We do not guarantee that AI outputs are original or non-infringing
• You are responsible for ensuring your use of AI outputs complies with applicable law

Feedback

If you provide feedback or suggestions about the Services, you grant us an unlimited, royalty-free license to use that feedback for any purpose.

You may stop using the Services at any time. To delete your account, use the account settings or contact help@arconi.ai.

We may suspend or terminate your access:

• For violation of these Terms
• For illegal or harmful activity
• To comply with law
• To protect the platform or other users
• For extended inactivity

Termination may occur without notice.

Upon termination:

• Your right to access the Services immediately ceases

We specifically disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain warranty exclusions. In those cases, the above may not fully apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Arconi Inc will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, or goodwill
• Damages resulting from AI-generated content
• Damages resulting from your reliance on the Services
• Damages resulting from unauthorized access to your account

Our total liability for any claims arising from these Terms or the Services will not exceed the greater of:

• The amount you paid to Arconi in the 12 months before the claim, or
• USD $100

Basis of the bargain

You acknowledge that Arconi has set its prices in reliance on these limitations, and that they form an essential part of the agreement between us.

Jurisdictional limits

Some jurisdictions do not allow certain limitations of liability. In those cases, our liability is limited to the minimum extent permitted by law.

16. Dispute Resolution

Informal resolution first

Before starting any formal proceeding, you agree to contact us at legal@arconi.ai and attempt to resolve the dispute informally. We will try to resolve it within 30 days.

Binding arbitration

You and Arconi agree to resolve most disputes through binding arbitration, not in court.

Arbitration will be conducted by JAMS under its applicable rules. The arbitration will take place in Wilmington, Delaware, unless we agree otherwise or the arbitrator determines a different location is appropriate.

The arbitrator's decision is final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver

You agree to resolve disputes individually, not as part of a class, collective, or representative action.

If for any reason a claim proceeds in court rather than arbitration, you and Arconi both waive any right to a jury trial.

Small claims exception

Either party may bring a claim in small claims court if the dispute qualifies.

Intellectual property exception

Either party may seek injunctive relief in court for infringement or misappropriation of intellectual property rights.

Opt-out right

You may opt out of this arbitration agreement by sending written notice to legal@arconi.ai within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out.

International users

This arbitration agreement applies to the maximum extent permitted by law in your jurisdiction. If any part is unenforceable where you live, only that part is severed.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts in Wilmington, Delaware.
